CLONMEL INSOLVENT COURT.

  Mr. HAMILTON LOWE was opposed by Mr. PEEL on behalf of Mr. James BURKE, the detaining creditor. The Insolvent was examined at some length, and Mr. FOLEY, of Lismore, (Receiver to the Estate under the Court of Chancery) stated bow it was circumstanced. The debts of the Insolvent set forth in the schedule amounted to near £3000. His property was at one time worth £800 per annum, but it produces little more at present than £400 Irish. In the year 1819, it was placed in the hands of Trustees, and Mr. DENNEHY became Receiver, in which office he continued until the year 1823, when Mr. FOLEY was appointed by the Court. In the course of his observations, Mr. FOLEY stated, that the balance at present in his hands, together with what he was about to pay over to the Judgment Creditors, was about £700. There was no effort, he observed, at concealment—every particular should willingly be explained which the Court required.
  Insolvent said—I owe to the Executors of Mr. Richard CLIFFE, (who was my brother-in-law) £900 part of which I received from his father, and part from himself. For the last 8 years I have had nothing whatever to do with my property, and have not received more than a guinea, from Mr. FOLEY; when I gave it up to Trustee, it produced about £800 a-year.
  In his Schedule he alleged that the Trustee received £2,900 of which they had as yet given in no account.
  Mr. FOLEY here observed that Mr DENNEHY, the former Receiver, swore at the foot of the settlement, a balance of £100 was due to him.
  Insolvent was promised £100 per annum for my maintenance—but since the year 1823 I have not received a farthing. My property is about to be sold by the Trustees; they are my own relations.
  Mr. FOLEY—The only one of the Trustees interested in the money matter is R. CLIFFE, and he is a residuary Legatee.
  After a lengthened inquiry, in the course of which Mr. FOLEY was very explicit as to the embarrassed state of the property in question, the Insolvent was discharged. Assignee, Mr. James BURKE, the detaining creditor.
