As they were pursuing him another boy came up to their assistance, who along with his son was a few yards nearer the man than he was; saw the man turn round and present a pistol at his son and servant boy while pursuing him; and afterwards saw the charge taken out of the pistol by the police; it was in a bog where the man was taken and when witness came up, the man was lying on the ground as if fainting, but witness thought it was all pretence; when the prisoner presented the pistol at his son during the pursuit he had the gun also under his left arm, identifies the prisoner at the bar as being the man whom he, his son and his servant boy pursued and took prisoner; had never seen the man before in his life. George Fox deposed that he is son of the last witness, and was in his father's house at Sion Hill, on the night that the gun was taken therefrom; was looking out of the kitchen door, and observed it under the man's arm, after he had gone a little distance from the house; witness with another boy pursued the man, & after a very long chase, came up with him and took him, and gave him up to Sergt. Fuller of the police; witness was about sixty yards from the man when he first observed the gun, but was only about ten yards distant when the man turned round and presented a pistol at him and snapped it: would not know the man again, as it was dark; Mr. West came up after the man was taken, and while he was lying on the ground. Edward West deposed, that he lives at Villerstown, and the night when the gun was taken out of Fox's house, he heard an alarm raised, in consequence of which he armed himself, and a few workmen whom he could depend upon; they went in pursuit of the robber; came up to the man, who was lying on the ground, and Fox's son and other two boys were standing beside him; the man lay as if he were in a faint, but being himself a professional man, he felt his pulse, and found it quite regular, at least as much so as any one's would be after being a little excited by exertion; in consequence he desired those who were present to drag the man a little, and having got him up he very suddenly recovered, when witness desired that the man should be brought on, as the country was in such a disturbed state, that he feared a rescue; they brought the prisoner to Killucan and gave him up to Sergeant Fuller of the police; saw the man searched, when several balls were found on his person; the pistol was loaded, witness saw the charge drawn out of it. This was an ejectment on the title, for recovering the vast estates of the late Samuel Dopping, of Lotown, in the County of Westmeath, Esq., brought by the plaintiffs as his co-heiresses at law, against the defendant, who claimed these estates under a will executed by the said Samuel Dopping, bearing date the 25th November, 1820. This will the plaintiffs alleged to be a Forgery, and the question at issue was, whether the will was genuine or fabricated, the onus lying on the defendant, and his counsel had to begin. Mr. Pennefather, who was brought down specially, stated the defendant's case, it was one of the finest displays of forensic eloquence ever heard in a court of justice; it occupied five fours, and there was loud and prolonged applause when he concluded. The examination of defendant's witnesses occupied until three o'clock on the second day of trial, and the case was so completely made out, that on the defendant's counsel having stated they had closed, Mr. Blackburne, who was brought down specially by the plaintiffs, now rose and said, that on consultation with the other Gentlemen concerned with him, they had come to the determination of submitting to a non-suit, it being admitted that the will had been most satisfactorily proved. This announcement was received by the loudest acclamation and cheering; indeed to such an extent was it carried, that the Judge was obliged to interfere to suppress it. The Jury declared that after the proceedings of the first day, their minds were made up. The crowds of tenants who were waiting the issue, outside the court house, caught the sounds of the cheering within, and the street of Trim, presented the greatest scene of confusion, so much so, that neither coach or horseman could pass for some time. The tenants wanted to chair the defendant to his lodgings, who declined it, and found it most difficult to effect his way through the crowd. Thus has terminated a suit, which if considered wither with respect to the stake at question, or the exertions made by the parties litigant, has nothing for many years to compete with it. The oldest man in Newport, Richard ROURKE, aged one hundred and three years, died here on Monday, having all his senses and the use of his limbs preserved to the last. The deceased was engaged in the great Irish rebellion, and it was to this town he escaped in a coaling vessel from bing arrested on that memorable occasion. They immediately drove to the strand contiguous to the county of Meath, and the persons that were in them having alighted, proceeded to the business of marking out the ground and charging the pistols, for a duel between two gentlemen, one of the name of DREW, and the other of O'BRIEN. Whatever the cause of quarrel might have been, it was soon decided, for on taking their places, and the signal being given by the seconds, they fired together, when instantaneously Mr. D. fell, dead! his opponent's ball having entered his forehead over the left eye, passing through the brain, and coming out at the back of his head! By this time numbers of the peasantry were assembled on the banks above the shore, something like an indistinct murmur was expressed, of taking the survivor into custody, but this was prevented by the immediate flight of himself and second to the post-chaise, which drove off with them with the rapidity of lightningnor were the rest of the party flow in followingfor before a quarter of an hour elapsed from their arrival, all had disappeared, leaving the breathless, bleeding body of their companion to the promiscuous care of the surrounding multitude. | NickR |
